HomeNote provides independent buyer-side decision-support reports for foreign buyers considering property purchases on the Costa del Sol. By placing an order on this website, you accept these Terms.

2. What HomeNote is not

To keep the role of the report clear, please note:

  • HomeNote is not a real estate agency.
  • HomeNote does not sell property and has no inventory.
  • HomeNote is not paid by the seller, and receives no commission, kickback or referral fee from any seller, developer or agent.
  • HomeNote is not a law firm.
  • HomeNote does not provide legal, tax, mortgage, investment, surveying, architectural or licensed valuation advice.

3. What the report is

The Independent Property Report is a written, buyer-side review of one property. It is prepared to help a prospective buyer think more clearly before committing. It typically covers:

  • One-page decision summary with HomeNote Rating, target price and opening offer
  • Property passport (address, micro-area, asking price, target price, listing link)
  • Price Test — €/m² evidence and comparable asking prices
  • Location Test — distances, demand signals and listing engagement
  • Rental Return Test — gross rent, net yield and vacancy sensitivity
  • 10-year scenario — capital growth and long-term rent, modelled across 10 years
  • Final view — key numbers and the questions to clear with the agent before deposit

The report is delivered as a typeset PDF in English or Spanish, as chosen by the buyer.

4. What the report is not

The report is a private decision-support document. It does not replace:

  • A lawyer's legal due diligence
  • A licensed valuer's formal valuation
  • An architect or surveyor's technical inspection
  • A bank's mortgage assessment
  • A tax advisor's personal tax analysis

Before committing to any property, you should always engage the relevant licensed professionals.

5. Basis of the report

The report is prepared based on the information reasonably available at the time of review — including the listing, the documents you provide, public registers we can consult, and our own observations of the market. We do not guarantee that this information is complete, that all relevant facts are publicly available, or that no material change occurs after delivery. The report represents a considered professional opinion, not a certified valuation, audit or legal opinion.

6. Your responsibility as the buyer

The decision to buy, negotiate, walk away or proceed in any way always remains with the buyer. The report is a tool to support that decision. You are responsible for:

  • Engaging a lawyer for legal due diligence before any deposit.
  • Engaging an architect, surveyor or other technical professional if relevant.
  • Engaging a tax advisor for any personal tax matter.
  • Confirming that any third-party introductions are independently suitable for you.

7. Price

The Independent Property Report is sold at a fixed price of €299 for one property. The fee covers the buyer-side review and the delivery of the final PDF report. Any additional service — for example, a second property review — is treated as a separate order.

8. Delivery

Our delivery target is within 24 hours, usually faster, from the moment we receive the listing link, the asking price and your buyer goal. If a specific property requires additional document checks, we tell you in advance and agree a realistic timing. The final report is delivered by email as a PDF.

9. Personalised report, cancellation and refunds

HomeNote reports are personalised buyer-side property decision reports prepared for a specific client request and a specific property or set of properties. When a client pays for a report, the client requests HomeNote to begin preparing the service after payment. Once the personalised report has been delivered, the service is considered performed.

If HomeNote has not yet started preparing the report and the client requests cancellation, HomeNote may issue a refund at its discretion or where required by applicable consumer law. If the report has already been delivered, refunds are generally not available unless there has been a clear service failure, duplicate payment or other issue requiring correction.

If the property you have sent is outside the Costa del Sol or outside our review scope, your payment is refunded in full. Examples of out-of-scope cases include, but are not limited to:

  • Properties outside our Costa del Sol coverage — Málaga, Torremolinos, Benalmádena, Fuengirola, Mijas, Marbella, Benahavís, Estepona, Casares, Sotogrande and their immediate surroundings.
  • Off-plan new-build sales where the available information does not support a meaningful buyer-side review.
  • Commercial property, plots, or other non-residential cases that fall outside our standard scope.

Refunds are processed via the original payment method. We aim to process refunds promptly after confirming scope.

10. No guarantee of outcome

The report supports the buyer's decision. It does not guarantee any specific outcome. In particular, HomeNote makes no promise or warranty as to:

  • Future appreciation of any property.
  • Achievable rental income, occupancy or yield.
  • Mortgage approval, financing terms or interest rates.
  • The outcome of any negotiation with the seller or agent.
  • Whether a particular purchase will go ahead, or its commercial result.

The buyer remains solely responsible for the final decision to buy, negotiate, walk away, finance, rent or hold any property.

11. Use of the report

The report is prepared for the named buyer and is for their personal use. It may be shared with the buyer's lawyer, accountant, partner or co-investor as part of the decision. The report may not be republished, resold or distributed as marketing material without our written consent.

12. Limitation of liability

To the maximum extent permitted by law, HomeNote's total liability arising from or in connection with a report is limited to the amount paid for that report (€299). HomeNote is not liable for indirect, consequential or special losses — including, without limitation, loss of profit, loss of opportunity, or losses caused by reliance on information from third parties.

13. Independence

HomeNote works only for the buyer. We are not paid by sellers, agents or developers. Where the report mentions other professionals (for example, a lawyer or technical inspector), no referral payment is received from them.

14. Confidentiality

Information you share with us — including the property details, your goal and any documents — is treated as confidential and used only to prepare your report and provide related communication.

15. Changes to the service

We may update the scope, structure or delivery format of the report over time, while preserving its buyer-side character. The version of the Terms applicable to your order is the one published on this website at the time of payment.

16. Governing law

These Terms are governed by Spanish law. Any dispute arising from the service will be addressed first through good-faith discussion. Where this is not possible, the competent courts will be those determined under applicable law.
